KEEP-MY-STONE-&-TILE-CLEAN-AND-HEALTHY SWEEPSTAKE OFFICIAL RULES

NO PURCHASE NECESSARY.

Sponsored by: MARBLELIFE DISTRIBUTION, INC.(“Sponsor”).

1. The Keep-My-Stone-&-Tile-Clean-and-Healthy Sweepstake (“Sweepstakes”) is open only to individuals at least eighteen (18) years of age or older at the time of entry and a legal resident of one of the fifty (50) states or the District of Columbia of the United States of America. Employees, officers and directors and their immediate family members (parents, children, siblings and spouse) of Sponsor, its franchisor and their respective parent companies, subsidiaries and affiliates are not eligible for Sweepstakes. The Sweepstakes and any entrant are subject to all applicable federal, state and local law and regulations (including taxes). The Sweepstakes is void where prohibited by law. Participation in the Sweepstakes constitutes entrant’s full and unconditional agreement to these Official Rules and Sponsor’s decisions, which are final and binding in all matters related to the Sweepstakes. Winning a prize is contingent upon fulfilling all requirements set forth herein.
2. Sweepstakes Period.The Sweepstakes will begin on OCTOBER 23 TH, 2014 at 12:00 a.m. Eastern Standard Time (“ET”) and ends on November 14th, 2014 at 11:59 p.m. ET (“Sweepstakes Period”).

3. How to Enter:During the Sweepstakes Period, go to Sponsor’s website located at MARBLELIFEproducts.com/marblelife-sweepstakes or on Sponsor’s Facebook page located at https://www.facebook.com/MARBLELIFECareProducts (If you do not already have a Facebook account, you may sign up for one for free at facebook.com). Then, follow the instructions to register for the Sweepstakes by completing the entry form with all required information and then clicking “Enter”. LIMIT ONE (1) ENTRY PER PERSON (regardless of the number of Facebook user accounts a person has). Multiple entrants are not permitted to share the same email address. Any attempt by any entrant to obtain more than the stated number of entries by using multiple/different Facebook user accounts, email addresses, identities, registrations and logins, or any other methods will void that entrant’s entries and that entrant may be disqualified. Use of any automated system to participate is prohibited and will result in disqualification. In the event of a dispute as to any registration, the authorized account holder of the Facebook or other applicable account used to register will be deemed to be the registrant. The “authorized account holder” is the natural person assigned to the Facebook account and related email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. Each potential winner may be required to show proof of being the authorized account holder.

4. Prizes/Odds of Winning.Three (3) MARBLELIFE® Absolutely Beautiful Home – Clean & Fresh Kit each with an Approximate retail value: $149.95, and a combined value of $449.85 [NOTE: pursuant to the laws of the State of Florida, the total prize amount shall not exceed $5,000.00]; subject to availability, and additional restrictions. Sponsor, in its sole and absolute discretion, shall determine the beginning and end dates of the prize. All unspecified expenses (including, but not limited to, freight and shipping costs over $50 to/from the manufacturer and winner) as well as applicable taxes on prize are the winner’s sole responsibility. If the actual retail value of the prize is $600 or more, Sponsor will furnish a 1099 IRS tax form to the winner for the actual retail value of the prize for the year in which the prize was won; and, such winner agrees to cooperate fully with Sponsor relative to Sponsor making any and all required tax filings in conjunction with prize award. The prize is not transferable without the express written consent of Sponsor which may be granted or withheld in its sole discretion without liability of any kind. There shall be no prize substitution except if determined by Sponsor and only then for prize/prize component of comparable value. Prizes are not redeemable/exchangeable by winners for cash. Limit of one (1) prize per family/household/address.  Each winner will receive one of the three kits available.  Odds of winning depend on the total number of eligible entries received.
5. Selection of Winners.The potential winner will be selected in a random drawing from among all eligible entries received. The drawing will be conducted by Sponsor on or about NOVEMBER 14^TH Potential winners will be notified by telephone and/or email and/or U.S. mail and must respond within FIVE (5) days to initiate prize claim procedure. Each winner may also be required to sign and return an Affidavit of Eligibility, a Liability Release and a Publicity Release (where lawful) within indicated time period. Noncompliance with the preceding requirements (as applicable) or if potential winner cannot be contacted for any reason (e.g., prize notification email is returned as undeliverable or prize notification email is not received due to classification as “junk”/”SPAM” or for any other reason) will result in prize forfeiture with an alternate potential winner being selected from among all remaining eligible entries received. Potential winners must continue to comply with all terms and conditions of these Official Rules. Winning is contingent upon fulfilling all requirements.
6. Conditions of Participation.By accepting prize, winner agrees to use by Sponsor and its designees of his/her name, likeness, photograph or other indicia of persona for advertising/publicity/promotional purposes in any media now or hereafter known throughout the world in perpetuity, without further compensation, permission or notification (unless prohibited by law). By participating, entrant indemnifies, releases and agrees to hold harmless Sponsor, its franchisees, franchisor and their respective parent companies, subsidiaries and affiliates; the directors, officers, agents, representatives, shareholders, employees, successors and assigns of any of the above organizations; and Facebook from any and all liability arising from the Sweepstakes and/or acceptance, receipt, possession or use/misuse of any prize and any activity, travel or travel-related activity thereto or participation in this Sweepstakes. Sponsor reserves the right, at its sole discretion, to disqualify any individual it finds, in its sole discretion, to be tampering (or attempting to tamper) with the entry process or the operation of the Sweepstakes or any web site; the preceding in no way precludes Sponsor from taking other actions against such individuals so as to protect its rights including, but not limited to the right to seek damages (including attorneys’ fees) and/or other remedies from any such person(s) responsible for tampering (or attempting to tamper) with the entry process or the operation of the Sweepstakes or any web site to the fullest extent permitted by law. Sponsor’s failure to enforce any provision of these Official Rules in a given circumstance shall not constitute the waiver of such provision. Sponsor assumes no responsibility for: (a) any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of any web site and/or entries; and/or (b) any problems or technical malfunctions of any telephone network or lines, computer on-line systems, servers or providers, computer equipment, software, programming or failure of email/entries to be received/recorded on account of technical problems or traffic congestion on the Internet or at any web site, filtering by the functionality of Facebook, or any combination thereof, or for injury or damage to entrant’s or to any person’s computer (or any information/materials stored therein) related to or resulting from downloading materials from any website or participating in the Sweepstakes. Sponsor also assumes no responsibility for late, lost, illegible/garbled, incomplete, damaged, inaccessible, corrupted or jumbled email transmissions or entries regardless of cause; and, all such entries are void. If, for any reason, the Sweepstakes (or any part thereof) is not capable of running as planned due to a force majeure event which is beyond the control of Sponsor (e.g., natural disaster, police action, computer virus or fraud), Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Sweepstakes and conduct the Sweepstakes and select the prize winner in a manner which is fair, equitable and in accordance with these Official Rules, as determined by Sponsor in its sole discretion. Notice of such action by Sponsor will be posted on the Sponsor’s Facebook page.

7. Dispute Resolution/Governing Law.To the fullest extent permitted by law, by participating in the Sweepstakes, you agree that: (a) any action at law or in equity arising out of or relating to these Official Rules or the rights and obligations of any entrant and/or Sponsor shall be settled by arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules, and judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof, (b) any and all disputes, claims, and causes of action arising out of or connected with these Official Rules or this Sweepstakes shall be resolved individually, without resort to any form of class action, (c) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred (if any), including costs associated with participating in this Sweepstakes but in no event attorneys’ fees and (d) under no circumstances will any entrant be permitted to obtain awards for and hereby waives all rights to claim punitive, exemplary, special, incidental, indirect and consequential damages and any other damages (whether due to negligence or otherwise), other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of any entrant and/or Sponsor, shall be governed by and construed in accordance with the laws of the State of Florida without giving effect or regard to any principles or doctrines of conflicts of law/choice of law of the State of Florida or of any other jurisdiction.
